OVERVIEW

Welcome to Maskadra. The terms “Maskadra,” “we,” “us” and “our” refer to the business operating this online store.

Maskadra operates this website and offers the information, content, features, products and services available through it collectively as the “Services.” Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service, together with the policies referenced in them, explain your rights and responsibilities when accessing the Services or purchasing products from Maskadra.

By accessing or using the Services, you agree to these Terms of Service and acknowledge our Privacy Policy. If you do not agree, you should not use the Services.

Nothing in these Terms excludes, limits or replaces any consumer right or legal remedy that cannot lawfully be excluded under the laws applicable to you.

1. ELIGIBILITY AND ACCOUNTS

You must be at least the age of legal majority in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian.

When creating an account or placing an order, you agree to provide accurate, current and complete information. You are responsible for safeguarding your account credentials and for activity conducted through your account.

You must notify us promptly if you believe your account has been accessed without authorization. Accounts may not be sold, transferred or assigned to another person without our consent.

2. PRODUCTS AND PRODUCT INFORMATION

Maskadra sells masks, costumes and related accessories intended primarily for entertainment, costume events and Halloween use.

We make reasonable efforts to display and describe our products accurately. However, colors and appearance may vary slightly depending on screen settings, lighting, manufacturing batches and photography.

Any material variation affecting the product’s essential characteristics will be disclosed where required by law. Nothing in this section limits your rights if a product is defective, damaged, unsafe, incorrect or materially different from its description.

Product descriptions, availability and prices may be updated prospectively without notice. Changes will not affect an order that we have already accepted unless required to correct an obvious error or agreed with you.

We may limit purchase quantities or discontinue products where reasonably necessary.

3. MASK SAFETY AND RESPONSIBLE USE

Before using a mask or costume, read and follow all instructions, labels, age recommendations and safety warnings supplied with the product.

Unless expressly stated otherwise, Maskadra products:

• Are costume and entertainment products;

• Are not personal protective equipment;

• Are not designed to protect against impact, chemicals, smoke, fire, disease or hazardous environments; and

• Should not be used for driving, operating machinery or participating in activities requiring unrestricted vision, hearing or movement.

Do not use a mask near open flames, excessive heat or another ignition source. Ensure that the mask does not dangerously restrict breathing, vision, hearing or movement.

Remove the mask immediately if you experience breathing difficulty, dizziness, overheating, skin irritation, an allergic reaction or significant discomfort.

Children must use masks and costumes only when the product is age-appropriate and under responsible adult supervision. Keep plastic packaging and small parts away from young children.

You are responsible for using products lawfully and safely. Masks must not be used to impersonate another person for fraud, evade law enforcement, threaten others or engage in illegal activity.

These safety instructions do not exclude liability or legal rights that cannot lawfully be excluded.

4. ORDERS AND CONTRACT FORMATION

Submitting an order constitutes an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance.

An order is accepted when we send confirmation that it has been accepted or shipped, depending on the checkout process applicable to your purchase.

We may refuse or cancel an order for legitimate reasons, including:

• Suspected fraud or unauthorized payment;

• Incorrect pricing or product information;

• Product unavailability;

• Shipping restrictions;

• Suspected commercial resale; or

• Violation of these Terms.

If we cancel an order after payment has been collected, we will refund the applicable amount using the original payment method.

5. PRICES, TAXES AND PAYMENT

Prices are displayed in the currency indicated at checkout. The final amount, including applicable shipping charges and taxes collected by us, will be shown before you complete payment.

Depending on the destination, customers may be responsible for import duties, customs charges, VAT or other governmental fees not collected at checkout. Any such responsibility will be disclosed where required by applicable law.

You agree to provide valid and accurate billing and payment information and represent that you are authorized to use the selected payment method.

We may correct an obvious pricing or calculation error before accepting an order. If an error is discovered after payment, we will contact you and, where appropriate, offer the option to confirm the corrected price or cancel the order for a full refund.

Promotional offers may be subject to additional terms. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion, subject to mandatory law.

6. SHIPPING AND DELIVERY

If an order is lost or damaged before delivery, we will provide the remedy required by applicable law, which may include replacement or refund.

7. RETURNS, CANCELLATIONS AND REFUNDS

Our voluntary 30-day return policy supplements and does not replace mandatory rights relating to defective, unsafe, damaged, incorrect or misdescribed products.

Customers in certain jurisdictions, including the European Union and United Kingdom, may have statutory cancellation or withdrawal rights in addition to our voluntary policy.

You may access and use the Services for personal, lawful and noncommercial purposes. You may not reproduce, distribute, modify, publish, sell, scrape or commercially exploit protected content without prior written permission, except where permitted by applicable law.

Shopify’s name, trademarks and platform materials belong to Shopify or its licensors. Third-party trademarks remain the property of their respective owners.

No provision of these Terms transfers ownership of any intellectual property to you.

10. THIRD-PARTY SERVICES AND LINKS

The Services may include payment processors, shipping providers, social media features, applications or links operated by third parties.

Third-party services are governed by their own terms and privacy practices. We are not responsible for independent third-party websites or services that we do not control.

This provision does not remove any responsibility Maskadra may have for service providers acting on our behalf or any consumer right that cannot legally be excluded.

11. RELATIONSHIP WITH SHOPIFY

Maskadra is powered by Shopify, which provides the ecommerce platform used to offer the Services.

Purchases from our store are made directly from Maskadra, not Shopify. Maskadra is responsible for its products, order fulfillment, customer support, refunds and compliance with applicable consumer laws.

Shopify is not the seller of Maskadra products and is not responsible for any sales agreement between you and Maskadra, except to the extent required by applicable law or Shopify’s own contractual obligations.

12. PRIVACY

Shopify and other service providers may process personal information to host the store, process payments, prevent fraud, provide analytics and perform other business functions.

We will not knowingly present fabricated reviews or conceal material incentives provided in exchange for reviews.

14. ERRORS AND CORRECTIONS

We may correct errors and update information prospectively. If an error materially affects an order already placed, we will notify you and provide any option or remedy required by applicable law.

We will not cancel an accepted order merely to avoid an advertised obligation where doing so would violate applicable consumer law.

• Death or personal injury caused by negligence where such liability cannot be excluded;

• Fraud or fraudulent misrepresentation;

• Willful misconduct or gross negligence where applicable;

• Defective or unsafe products where mandatory product liability law applies; or

• Violation of mandatory consumer rights.

Where liability may legally be limited, Maskadra’s aggregate liability relating to a purchase will not exceed the amount paid for the affected product, except where applicable law requires a different remedy or does not permit that limitation.

19. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for third-party claims arising directly from your unlawful misuse of the Services, infringement of another person’s rights or material breach of these Terms.

This section does not require a consumer to compensate Maskadra for losses caused by Maskadra, its service providers or a defective product, and does not remove any mandatory legal protection.

20. SUSPENSION AND TERMINATION

We may suspend or terminate access to an account when we reasonably believe there has been fraud, unlawful activity, a material breach of these Terms or a security risk.

Termination does not affect accepted orders, accrued payment obligations, refunds, consumer remedies or provisions that by their nature remain applicable after termination.

21. SEVERABILITY

If a provision of these Terms is found unlawful, unfair or unenforceable, it will be enforced only to the maximum extent permitted or removed where required. The remaining provisions will continue to apply where legally possible.

22. NO WAIVER

A failure or delay in enforcing a provision does not waive the right to enforce it later.

These Terms and the policies expressly incorporated by reference form the agreement governing use of the Services and purchases from Maskadra.

Nothing in this section excludes statements, product descriptions or representations that applicable law treats as binding.

24. ASSIGNMENT

You may not transfer your contractual rights or obligations without our consent, except where applicable law permits.

We may transfer our rights and obligations as part of a sale, reorganization or transfer of the business, provided that doing so does not reduce your mandatory rights. We will provide notice where required by law.

25. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the jurisdiction in which Maskadra’s legal business entity is established, without applying rules that would improperly deprive a consumer of mandatory protections available in their country of residence.

If you are a consumer, you may bring a claim in any court or forum available to you under mandatory applicable law. Nothing in these Terms requires you to waive a legally protected forum or remedy.

26. CHANGES TO THESE TERMS

We may update these Terms to reflect legal, operational or service changes.

Material changes will apply prospectively and will be communicated where required by law. Changes will not retroactively reduce rights relating to orders already accepted.
